Overview

Welcome to The Living Word. In this document, the words "we," "us," and "our" mean The Living Word, the operator of the website at thelivingword.shop and the related store, content, features, tools, products, and services we make available to you (collectively, the "Services").

These Terms of Service, along with any policies they reference (together, the "Terms"), set out the rules that apply when you use the Services and explain the rights and responsibilities of both you and us. Please read them carefully — they include important provisions covering warranty disclaimers, limits on our liability, and how disputes are handled.

If you create an account, you are responsible for protecting your login credentials and for any activity that occurs under your account. Accounts are personal to you and may not be transferred, sold, leased, or assigned to anyone else.

We do our best to display every Bible, book, and related item in our store accurately. That said, the way colors, textures, and materials appear on your screen can vary depending on the device and display settings you use, and we cannot guarantee that physical products will match the on-screen presentation exactly.

Product descriptions, availability, and assortment can change at any time without notice. We may discontinue any item, and we may limit the quantities sold to any individual, region, or jurisdiction at our discretion.

Section 3 — Orders

Placing an order through the Services is an offer from you to purchase the items in your cart. The Living Word reserves the right to accept or decline any order, in whole or in part, for any lawful reason. An order is not accepted until we confirm acceptance, and we must receive and successfully process your payment before that happens.

Please review your cart and order details carefully before submitting. Once an order has been accepted, we may not be able to honor cancellation or modification requests. If we decline, change, or cancel an order, we will try to reach you using the email address or phone number provided at checkout.

Returns and exchanges are handled in accordance with our Refund Policy. Items may be returned within 30 days of delivery, subject to the terms of that policy.

You represent and warrant that any items you buy from us are intended for your personal or household use, and not for commercial resale, distribution, or export.

Section 4 — Prices and Billing

Product pricing, discounts, and promotional offers can change without notice. The price you pay for any item is the price displayed at the moment your order is placed, and that amount will appear on your order confirmation email.

Unless we say otherwise, listed prices do not include taxes, shipping charges, handling fees, or any customs or import duties that may apply. Prices on thelivingword.shop may differ from prices offered through any third-party marketplace, retailer, or affiliate.

From time to time we may run promotions with their own terms. If a promotion's terms conflict with these Terms, the promotion's terms will control for that promotion only.

You agree to provide current, complete, and accurate purchase, payment, and account information for every order. You also agree to keep your account details — including email address and payment method — up to date so we can process your transactions and contact you when needed. By submitting payment information, you represent that the payment method is valid and authorized for your use, that the charges will be honored, and that you will pay all amounts due, including applicable shipping fees and taxes.

Section 5 — Shipping and Delivery

All shipping and delivery dates we provide are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, weather, customs processing, or any other circumstances outside our control. Once an order is handed off to the shipping carrier, title to and risk of loss for the items pass to you.

Section 6 — Intellectual Property

The Services — including the site design, page layouts, text, logos, images, photography, graphics, video, audio, and the selection and arrangement of all of the above — are owned by The Living Word, our affiliates, or our licensors, and are protected by U.S. and international copyright, trademark, and other intellectual property laws.

These Terms allow you to use the Services for your personal, non-commercial use only. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, transmit, or otherwise exploit any material from the Services without our prior written permission.

Nothing in these Terms grants you any license or rights to any patent, trademark, copyright, or other intellectual property of The Living Word or any third party, except for the limited use rights expressly described above. Unauthorized use of the Services may violate federal, state, or international intellectual property laws. All rights not expressly granted in these Terms are reserved.

The name "The Living Word," our logo, and the names, designs, and slogans associated with our products and services are trademarks of The Living Word or our licensors. You may not use them without our prior written consent. All other trademarks, names, and logos that appear on the Services belong to their respective owners.

Section 7 — Optional Tools

We may, from time to time, give you access to optional tools, widgets, or features provided by third parties through the Services. We do not monitor, control, or have any input into those tools, and we provide access to them on an "as is" and "as available" basis with no warranties, representations, or endorsements of any kind.

Any use you make of these third-party tools is at your own risk and discretion. You should review the relevant third party's terms before relying on them. We have no liability arising from your use of any third-party tool offered through the Services.

We may also introduce new features, tools, or resources through the Services in the future. Any such additions will be considered part of the Services and will be governed by these Terms.

Section 9 — Hosting and E-Commerce Platform

The Services are made available with the help of our e-commerce and hosting providers. While these providers help us run thelivingword.shop and process orders, every sale on our store is made directly between you and The Living Word.

By using the Services, you acknowledge that our hosting and platform providers are not responsible for any aspect of any sale between you and The Living Word, including any injury, damage, or loss arising from products you purchase, and you release them and their affiliates from any related claims.

If you submit, post, email, upload, or otherwise share any ideas, suggestions, comments, reviews, proposals, or other content with us (collectively, "Feedback"), you grant The Living Word a perpetual, worldwide, royalty-free, sublicensable, transferable license to use, copy, modify, publish, distribute, display, and otherwise exploit that Feedback in any medium and for any purpose, including for commercial use.

We may use that license to operate, evaluate, improve, and promote the Services and to fulfill our obligations and exercise our rights under these Terms. You also represent and warrant that (i) you own or have all necessary rights to the Feedback you share, (ii) you have disclosed any compensation or incentive you received in connection with sharing it, and (iii) the Feedback complies with these Terms.

We are not obligated to keep your Feedback confidential, to compensate you for it, or to respond to it. We may, but are not required to, monitor, edit, or remove any Feedback that we determine, in our sole discretion, to be unlawful, offensive, defamatory, obscene, infringing, or otherwise objectionable.

You agree that your Feedback will not violate any third party's rights, including copyright, trademark, privacy, publicity, or other personal or proprietary rights, and that it will not contain unlawful, abusive, or obscene content, malware, or anything else that could affect the operation of the Services. You may not use a false email address, impersonate another person, or otherwise mislead us or other users about the source of your Feedback. You are solely responsible for any Feedback you provide and for its accuracy. We accept no responsibility or liability for Feedback posted by you or any third party.

From time to time the Services may contain typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, shipping rates, transit times, or availability.   • to engage in any other conduct that restricts another person's use or enjoyment of the Services, or that, in our judgment, could harm The Living Word, our service providers, or other users, or expose any of them to liability.

You also agree not to:

  • upload or transmit any virus, worm, or other malicious code that could affect how the Services function;

  • reproduce, copy, sell, resell, or otherwise commercially exploit any portion of the Services;

  • collect or harvest other users' personal information;

  • spam, phish, pharm, pretext, spider, crawl, or scrape any part of the Services; or

  • interfere with or attempt to bypass the security features of the Services or any related system or website.

We reserve the right to suspend, restrict, disable, or terminate your account or your access to the Services at any time, without notice, if we determine that you have violated any part of these Terms.

We may terminate this agreement, or your access to all or any part of the Services, at our sole discretion at any time and without notice. You will remain responsible for any amounts you owe through and including the date of termination.

The following sections will continue to apply after any termination of these Terms or your access to the Services: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other section that by its nature should survive.

Section 15 — Disclaimer of Warranties

The information made available through the Services is provided for general information only. We do not warrant the accuracy, completeness, currency, or usefulness of any of it, and any reliance you place on such information is strictly at your own risk. We disclaim all liability arising from your reliance, or the reliance of any other visitor or person, on materials available through the Services.

EXCEPT WHERE EXPRESSLY STATED BY THE LIVING WORD, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THEM ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT REPRESENTATIONS, WARRANTIES, OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO PARTS OF THIS DISCLAIMER MAY NOT APPLY TO YOU.

Section 16 — Limitation of Liability

TO THE FULLEST EXTENT ALLOWED BY LAW, IN NO EVENT WILL THE LIVING WORD OR ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, SERVICE PROVIDERS, OR LICENSORS BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND — INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, OR REPLACEMENT COSTS — WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THEM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Section 17 — Indemnification

You agree to indemnify, defend, and hold harmless The Living Word and our affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from and against any losses, damages, liabilities, costs, or claims — including reasonable attorneys' fees — payable to any third party and arising out of (1) your breach of these Terms or any policy referenced in them, (2) your violation of any law or third-party right, or (3) your access to or use of the Services.

We will notify you of any indemnifiable claim, but our failure to notify you promptly will not relieve you of your obligations unless you are materially prejudiced. We may take control of the defense and settlement of any indemnified claim at your expense, including the choice of counsel, but we will not settle a claim that imposes non-monetary obligations on you without your consent (which will not be unreasonably withheld). You agree to cooperate with us in the defense of any indemnified claim, including by making relevant documents and information available.

Section 18 — Severability

If any provision of these Terms is held to be unlawful, void, or otherwise unenforceable, that provision will still be enforced to the fullest extent allowed by law, and the unenforceable portion will be considered severed from these Terms. The validity and enforceability of the remaining provisions will not be affected.

Section 19 — Waiver; Entire Agreement

Our failure to exercise or enforce any right or provision of these Terms will not be considered a waiver of that right or provision. These Terms, together with any policies or operating rules we post on thelivingword.shop or otherwise make a part of the Services, make up the entire agreement and understanding between you and us regarding your use of the Services, and they supersede any earlier or contemporaneous agreements, communications, or proposals between us, whether oral or written, including any prior versions of these Terms. Any ambiguity in interpreting these Terms will not be construed against the drafting party.

Section 20 — Assignment

You may not assign, transfer, or delegate these Terms, or any of your rights or obligations under them, without our prior written consent. Any attempt to do so will be null and void. We may assign, transfer, or delegate these Terms and our rights and obligations under them at any time, without consent or notice to you.

Section 21 — Governing Law

These Terms and any separate agreements through which we provide you Services are governed by, and construed in accordance with, the laws of the State of [STATE] and the federal laws of the United States, without regard to conflict-of-laws principles. You and The Living Word agree to the exclusive venue and personal jurisdiction of the federal and state courts located in [COUNTY], [STATE] for any matter not subject to arbitration as described below.

Section 22 — Dispute Resolution and Arbitration

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and to have a jury hear your claims. It provides that disputes between you and The Living Word will be resolved through binding individual arbitration rather than in court.

Agreement to Arbitrate

You and The Living Word agree that any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Services, any products or services purchased through the Services, or the relationship between you and The Living Word (collectively, "Claims") will be resolved through binding individual arbitration. The only exception is that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of that party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

Waiver of Class Actions and Class Arbitrations

You and The Living Word agree that each party may bring Claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. Unless we both agree otherwise in writing, the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated, and may not preside over any form of representative, private attorney general, or class proceeding.

Opt-Out Right

You have the right to opt out of this arbitration provision by sending written notice of your decision to opt out to support@thelivingword.shop within thirty (30) days of your first purchase or first use of the Services, whichever comes first. Your notice must include your name, mailing address, and a clear statement that you wish to opt out of this arbitration agreement. If you opt out of this arbitration provision, The Living Word will also not be bound by it as to you.

Severability

If any portion of this arbitration provision is found to be unenforceable or unlawful for any reason, (1) the unenforceable or unlawful portion will be severed from these Terms; (2) severance of the unenforceable or unlawful portion will not affect the enforceability of the remainder of the arbitration provision or the parties' ability to compel arbitration of any remaining Claims on an individual basis; and (3) to the extent any Claims must therefore proceed on a class, collective, consolidated, or representative basis, those Claims must be litigated in a court of competent jurisdiction and not in arbitration, and litigation of those Claims will be stayed pending the outcome of any individual Claims in arbitration.

You can review the current version of these Terms at any time on this page. We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms by posting updates and changes to thelivingword.shop. It is your responsibility to check this page from time to time. We will notify you of any material changes as required by applicable law, and those changes will take effect on the date specified in the notice. Your continued use of the Services after the posting of any changes means you accept those changes.
